The Affiliate Program is not Multi Level; however, we think that many will find that 20% paid on the 1st level and 25% on the 2nd level for the Maca Live will prove to be more beneficial than many MLM programs. There is no fine print, and there are no tricky rules. This is the whole program.

When you refer someone to Maca Live, any time and every time they purchase products, you will earn a commission. The commission will be from 20% on the 1st level. The Affiliates will be paid on their direct contacts only and not on their contacts' referrals, unless those contacts' referrals register directly under the Affiliates's organization (known as 2nd level), only then will the affiliates receive a 25% commission on their contacts' referrals.

CREDIT: Payable as a Gift Certificate for credit toward purchases of Maca Live products. Gift Certificate credit will be applied to your customer Account and available for you to use within a few days after an order you have referred has been processed.

CASH: If an Affiliate would prefer to receive cash instead of product credit (Gift Certificate), they may contact Maca Live at 310 543-2705 and convert any Gift Certificate credit into cash at the rate of $0.75 for every $1.00 of Gift Certificate credit, and a check will immediately be issued.

If you refer a customer who is already sponsored by someone else, we will assume that the first sponsorship takes precedence. However, if there is a conflict regarding sponsorship of a customer, we will attempt to arrive at a consensus of the two sponsors and the customer. If that is not possible, we will look to the customer to resolve the sponsorship issue.

You may login to view a report of all sponsored sales for which you have received credit. If you notice that you have not properly received credit for a sponsored sale, contact Maca Live immediately at 1-310-543-2705.

The Affiliate Program is now available to Maca Live members all over the world. If an Affiliate outside the US chooses to receive cash instead of Gift Certificate credit, there are issues of currency exchange rates and the cost of wiring funds. This agreement describes the entire terms and conditions for participation in the Maca Live Affiliate program. In this agreement, the term "Affiliates" refers to you, the applicant. " Maca Live " refers to The Maca Live Affiliate Program and it's subsidiaries.

The following points summarize the agreement between Maca Live and the Affiliates:

1. The Affiliates has the ability to promote according to the current promotional opportunity. See Appendix A

2. The Affiliates will limit its marketing and promotional materials to those supplied or purchased from Maca Live. All materials supplied by The Maca Live Affiliate program are copyright protected and cannot be duplicated without express written permission from Maca Live. Anything created outside of these materials must be approved by Maca Live prior to use. This includes, but is not limited to newspaper ads, newsletters, e-mail promotions and audio media.

3. Affiliates will only be paid on new contacts that are not already in The Maca Live Affiliate program' database and/or linked to another Affiliate. Affiliates will not be permitted to purchase or register for courses under their own referral number in order to receive commissions on themselves.

4. The right to attend any Maca Live or Soul Fires courses detailed within the Current Promotional Opportunity in Appendix A cannot be assigned or transferred to any party for monies, benefits or consideration. All registrations must originate from and through Maca Live.

5. The commissionable value of products or programs will be the final price offered by The Maca Live Affiliate program to the contact, and for which money is actually received, after all discounts, incentives, reductions, shipping fees and promotions have been accounted for. The "Commissionable Value", in most cases, is less than the regular published or advertised price.

6. The "Commissions Due" are only payable once the commissionable items have been paid for in full and fulfilled.

7. The Maca Live Affiliate program will apply every effort to keep its website current and operational. However, technical difficulties may arise from time to time, resulting in temporary service interruptions. Maca Live will not be held responsible for such interruptions and any subsequent loss of Affiliates commissions.

8. To be sure an Affiliates's contacts are tracked effectively; contacts must click on the Affiliates web link exactly as provided by The Maca Live Affiliate program. Maca Live is not responsible for human error or technical difficulties that occur when a person is registering while using the Internet Affiliates link. We shall not be liable to you for failure by you to properly use the Affiliates web link, even if such failure results in the reduction of referral fees due to you under this Agreement.

9. The Affiliate is responsible for maintaining a current e-mail address via the Affiliates website. Maca Live will not be responsible for e-mail communications not received by Affiliates.

10. Maca Live reserves the right to change any part of this agreement at any time. The Affiliates will be notified by email about any material changes to this agreement at which time the Affiliates may withdraw within two weeks of receiving such notice. Withdrawal must be received in writing to Maca Live during which time the previous agreement will be in force.

11. The Affiliates agrees to abide by the Maca Live Anti-Spam Policy (Appendix B).

12. Maca Live reserves the right to disallow any given person or company into the Internet Affiliates Program, at its sole discretion.

13. Maca Live reserves the right to terminate this agreement at any time, at its sole discretion.

14. Maca Live shall have no liability for any indirect, incidental, or consequential damages or any loss of revenue or profits arising under or with respect to this agreement or the Maca Live Internet Affiliates Program.

15. In entering into this agreement, the Affiliates in no way becomes a partner, agent, representative or employee of Maca Live and may not represent themselves as such.

16. The Affiliates agrees to file and remit the appropriate taxes on commissions received.

17. In case of any disagreement in terms between this agreement and any previous written, verbal agreement or online the terms of this agreement will take precedence.

18. Only those agreements that have been accepted by Maca Live will be considered valid and in effect.

19. Participation in the Internet Affiliates program is de-facto proof of the Affiliates's acceptance of the Internet Affiliates Agreement in its entirety.

20. If one clause in the Internet Affiliates Agreement is deemed unenforceable, it will not deem the entire contract void.

The Affiliates will receive 10 to 20% commission on 1st level and 10 to 25% commission on 2nd level of the Commissionable Value for qualifying products. The following 6 items describe the conditions for commission payment to the Affiliates for products purchased by their contacts:

b) Commissions are payable as either a Gift Certificate for credit toward purchases of Maca Live products or cash. Gift Certificate credit will be applied to your customer Account and available for you to use within a few days after an order you have referred has been processed. c) Any commissionable sales for which a refund is made by Maca Live will not result in a commission payable to the Affiliates and adjustments will be made accordingly on the next scheduled commission payment date if required.

The Affiliates has the ability to purchase marketing materials from Maca Live for their contacts; Maca Live will provide marketing materials at its cost plus 10%, plus shipping, unless otherwise agreed in writing.

The Affiliates will be paid on their direct contacts only and not on their contacts' referrals, unless those contacts' referrals register directly under the Affiliates's organization. Affiliates will receive a 25% commission on their contacts' referrals (2nd level).

The Affiliates of the Commissionable Value, of The Maca Live Affiliate program, is payable within 90 days of the fees being collected and paid in full and the product being fulfilled.

Any family member, guest administration registration fees or re-attend registration fees are not commissionable on workshops.

The Maca Live Affiliate program is committed to permission-based email marketing practices. We have established this no-tolerance Anti-Spam Policy. The Maca Live Affiliate program may update this policy and provide notice of any changes on its home page. Your use of this website constitutes your acceptance of the terms and conditions of our Anti-Spam Policy.

Spam is commercial email or unsolicited bulk email, including junk mail, which has not been requested by the recipient. Spam is the opposite of permission-based email.

Spam is not an accepted promotion technique and Maca Live does not condone or engage in Spam and does not tolerate Spam of any sort. Maca Live Affiliates, Joint Venture Partners, Customers and active students, you are strictly forbidden to advertise or promote Maca Live programs, products, or services, via any form of Spam. Maca Live, Joint Venture Partners, Customers and active students, agree to comply with this Anti-Spam Policy. Maca Live reserves the right to determine in its sole discretion what constitutes Spam.

The Maca Live Affiliate program, Joint Venture Partners, Customers and active students found to be using Maca Live Affiliate program, products or services to engage in Spam may, at Maca Live discretion, be immediately cut off from use of all Maca Live Affiliate program, products and services. Maca Live will take any steps it deems necessary to prevent it from being involved in Spam and will legally pursue any person(s) or organization(s) that involve it in Spam allegations. If damages of any kind are levied against Maca Live, it will pursue full legal recourse against the offending person(s) and/or organization(s) under any and all applicable laws.

If you believe that you have received Spam connected to Maca Live in any way, send a complaint including the unsolicited email, to abuse@Livengood-Lifestyles.com. You may also provide any other information that you believe may help a Maca Live investigation. Maca Live does not investigate or take any action based on anonymous Spam complaints.

Individuals who sign up on any Maca Live Affiliate program website for programs, free evening seminars, teleclasses, products or for any other reason, and provide their email address, give Maca Live permission to send information on Maca Live programs, products and services to said email address. In order to protect your privacy, Maca Live does not sell, share or trade our subscriber list with anyone for any reason and you may unsubscribe at any time.
